Overview
These Terms and Conditions (“Terms”) govern your access to and use of Focus Cubes’ websites, applications, browser extensions, dashboards, and related services (collectively, the “Services”). The Services are operated by Focus Cubes LLC, a North Carolina company (“Focus Cubes,” “we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

Eligibility and Use
Focus Cubes is intended for working adults. You may use the Services only if you are at least 18 years old and are authorized to use the Services through your workplace or organization.

Focus Cubes provides tools to support everyday stress management, focus, and emotional regulation at work. Focus Cubes does not provide medical advice, diagnosis, or treatment. The Services are not a substitute for professional medical or mental health care.

Privacy
Your use of the Services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Focus Cubes is designed to protect individual privacy. Managers may see aggregated, anonymized data only. Managers do not have access to individual-level data. Aggregated insights are designed to prevent identification of any individual. Focus Cubes does not sell personal data. Please review the Privacy Policy for full details.

Accounts and Acceptable Use
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. You may not share your account or allow others to access the Services using your credentials. Notify us promptly if you believe your account has been compromised.

You agree not to use the Services for unlawful purposes, to attempt to reverse engineer, scrape, or interfere with the Services, to use the Services to monitor, surveil, or evaluate others, or to attempt to identify individuals or misuse outputs. We may suspend or terminate access if these Terms are violated.

Some features may be offered as part of pilots or early access programs. During these periods, features may change or be discontinued, availability and performance are not guaranteed, and feedback may be used to improve the Services.

Intellectual Property and Third Parties
All rights in the Services, including software, designs, workflows, and content, are owned by Focus Cubes or its licensors. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services solely as intended and in accordance with these Terms.

The Services may rely on third-party infrastructure or tools such as hosting or analytics providers. Focus Cubes is not responsible for third-party services or sites.

Disclaimers and Liability
The Services are provided “as is” and “as available.” We do not guarantee continuous or error-free operation or specific outcomes related to stress reduction, focus, or wellbeing. Outputs or suggestions may not always be accurate or appropriate for every situation, and you remain responsible for how you use the Services.

To the maximum extent permitted by law, Focus Cubes will not be liable for indirect, incidental, special, consequential, or punitive damages. Focus Cubes’ total liability for any claim arising out of or related to the Services is limited to the amount actually paid to Focus Cubes for the Services. If no fees were paid, Focus Cubes’ liability will be zero.

You agree to indemnify and hold harmless Focus Cubes and its officers, directors, employees, and agents from claims arising from your misuse of the Services, your violation of these Terms, or your violation of applicable laws.

Termination, Changes, and Law
You may stop using the Services at any time. We may suspend or terminate access if these Terms are violated or if continued access poses legal, security, or operational risk. Data handling after termination is governed by our Privacy Policy.

We may update these Terms from time to time. Material changes will be communicated through the Services or by email.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law principles.
